1. Purpose & Scope
These general terms and conditions of sale (the “GTC”) govern all sales of clothing and accessories offered by HYPEUSE (hereinafter referred to as "HYPEUSE") via https://www.hypeuse.com, as well as the rights and obligations of the parties in this context. HYPEUSE is a sole proprietorship registered under the SIREN number 537 432 668, whose registered office is located at 200 De la Croix Nivert Street, 75015 Paris, France.
Placing an order constitutes full and unreserved acceptance of these General Terms of Sale, which supersede all other documents, unless special terms have been agreed in writing. HYPEUSE reserves the right to modify them at any time; the applicable version is the one in effect on the date of the order.
Customers acting in their capacity as consumers are entitled to the protections set out in the French Consumer Code, without prejudice to these General Terms and Conditions of Sale (CGV).
2. Product information is availability
The essential product features are displayed on https://www.hypeuse.com This content is provided for informational purposes only, with the reasonable degree of accuracy that may be expected. Photographs, visuals, and descriptions are not strictly contractually binding and may contain minor variations.
Offers are valid for as long as they are visible online, subject to stock limits and availability. In the event an item is unavailable after an order is placed, HYPEUSE notifies the customer as promptly as possible and, where applicable, processes a refund of all sums paid for the unavailable item.
3. Prices, taxes & promotions
The applicable prices are those displayed at the time your order is confirmed. All prices are listed in euros. VAT is not applicable — Article 293 B of the French General Tax Code (the base exemption for micro-enterprises); no VAT is charged. Any shipping, service, or other additional fees will be displayed before you confirm your order.
Promotions, discount codes, and special offers are valid for the advertised duration and under the stated terms, and may not be combined unless explicitly specified. HYPEUSE reserves the right to modify its prices at any time, with the explicit clarification that all products are billed at the rates in effect at the time the order is placed.
4. Order & Confirmation
The customer selects their products, reviews their order details, and can correct any errors before confirming their order. The order is only final once it has been validated by the customer and, where applicable, payment has been confirmed.
An order summary is sent via email to the address provided by the customer. It is the customer’s responsibility to provide accurate information; HYPEUSE cannot be held responsible for any consequences arising from inaccurate or incomplete information. HYPEUSE reserves the right to refuse or cancel any order for a legitimate reason (prior dispute, unusual order, suspected fraud)
5. Payment
Accepted payment methods are:
- Bank card
- PayPal
- Shop Pay
- Apple Pay
- Google Pay
- Klarna
Full payment is due in full at the time of order, unless the customer selects a deferred or split payment solution offered by Klarna.
When a customer chooses Klarna, their payment is subject to Klarna's own terms of use and acceptance conditions. HYPEUSE is not involved in the decision to accept or reject deferred or installment payments.
Your order will only be deemed final once payment has been accepted by the relevant banking institution or payment service provider.
If your payment fails, is declined, or cannot be processed, your order cannot be finalized, or may be canceled by HYPEUSE.
HYPEUSE also reserves the right to refuse or cancel an order in the event of suspected fraud, fraudulent use of a payment method, or a dispute relating to payment for a previous order.
Payment security. Transactions completed on the site are secured by the payment providers used by HYPEUSE. HYPEUSE does not have access to the customer's confidential banking data.
6. Delivery
Products are delivered to the addresses and geographic regions presented to the customer during checkout.
The customer is responsible for the accuracy and completeness of the delivery information they provide. HYPEUSE shall not be held liable for any delivery delay or inability to deliver resulting from an incorrect, incomplete, or inaccessible address.
Orders are prepared as quickly as possible after payment is confirmed.
The delivery methods offered may include, among others:
- delivery to a pickup point via Mondial Relay
- Home delivery via Colissimo
- any other delivery methods that may be displayed during checkout
The estimated shipping costs and delivery timelines are provided to the customer before they finalize their order.
The delivery times listed on the website are for reference only, unless a specific date or lead time has been explicitly agreed upon with the customer.
In the event of a delivery delay, the customer is entitled to the rights set out in the Consumer Code. They may, in particular, request to HYPEUSE to complete delivery within a reasonable additional period, then, in the event that no delivery is made within this new timeframe, request cancellation of the order.
The risk of loss of or damage to the products transfers to the customer at the point when the customer, or a third party they have designated (other than the carrier), takes physical possession of the products.
When delivery is made to a pickup point, the customer must collect their parcel within the timeframe specified by the carrier. In the event the parcel is not collected and is returned to HYPEUSE, the costs of a new shipment may be charged to the customer.
Upon receiving their order, the customer is asked to check the condition of the package and all products. Any irregularities, damage, or missing items must be reported promptly to HYPEUSE, if possible, accompanied by photographs of the package and the product concerned.
7. Right of withdrawal
In accordance with applicable regulations for distance sales, the consumer customer has a fourteen-day period to exercise their right of withdrawal, without being required to justify their decision.
This period starts on the day the customer, or a third party they have appointed (other than the delivery carrier), receives the product.
If your order contains multiple products that are delivered separately, the applicable deadline starts from the date you receive the final product.
The customer may exercise their right of withdrawal by using the returns portal available on the website, the standard form located at the end of these General Terms and Conditions of Sale, or by sending correspondence to HYPEUSE a clear statement expressing your intent to withdraw.
The request must be submitted before the 14-day deadline expires.
The customer must then return the product within a maximum of fourteen days following notification of their decision to withdraw from their purchase.
Products must be returned:
- unworn, except for reasonable trial fitting
- unwashed
- undamaged
- free of odors, stains, or signs of use
- with their tags and, wherever possible, their original packaging
The customer may only handle and test the product to the extent necessary to verify its nature, features, and size. The customer may be held liable for any reduction in the product’s value resulting from handling that exceeds what is necessary.
Direct return costs are the responsibility of the customer, except in the event of a preparation error attributable to HYPEUSE, defective product or product received damaged.
Customers must not return their product to any address without first following the return process provided by HYPEUSE.
HYPEUSE will refund all sums owed within a maximum period of fourteen days from the date on which it was notified of the withdrawal decision. HYPEUSE may delay the refund until the product is recovered, or until the customer provides proof of shipping the item; the applicable date will be that of the first of these two events to occur.
The refund will be processed using the same payment method that was used to place the order, unless the customer agrees otherwise.
If you cancel your entire order, the initial standard delivery fees will be refunded. Any additional fees incurred from choosing a more expensive delivery method than the offered standard option will not be refunded.
For contracts concluded online, HYPEUSE provides the customer with a free, easily accessible feature that allows them to exercise their right of withdrawal before the legal deadline expires.
The statutory cooling-off period for online purchases of goods is 14 days, starting from the date of receipt.
Exceptions to the right of withdrawal
The right of withdrawal may in particular not be exercised for:
- products made to the customer’s specifications, or that are clearly customized.
- Products that are opened after delivery may not be returned for health or hygiene reasons, where this legal exception applies.
This exception does not allow for the automatic refusal of returns for an item of clothing that has only been tried on under normal conditions.
8. Statutory warranties
Products sold by HYPEUSE are covered by the statutory warranty of conformity and the statutory warranty against hidden defects, under the conditions set forth by law.
Legal Guarantee of Conformity
Consumers may invoke the statutory conformity guarantee when a delivered product does not match their order, has a defect, or lacks the qualities normally expected of a similar product.
In the event of a lack of conformity, the customer may request that the product be brought into compliance via repair or replacement, under the conditions and limits set out by law.
If repair or replacement is impossible, unreasonably costly, or not completed within the required timeframe, the customer may request a price reduction or termination of the contract under the applicable legal conditions.
Warranty against hidden defects
The customer may also be eligible for the warranty covering hidden defects that render the product unfit for its intended use, or that diminish its functionality so severely that the customer would not have purchased the product, or would have paid a lower price for it, had they been aware of these defects.
For any claim under a statutory warranty, the customer must contact the customer support team of HYPEUSE and submit all relevant details, including your order number, a description of the issue, and photos of the product.
Statutory warranties apply regardless of any goodwill gesture extended by HYPEUSE.
9. Liability & force majeure
HYPEUSE shall be responsible for the proper performance of all obligations arising from the contract entered into with the customer, in accordance with the applicable legal provisions.
HYPEUSE shall not, however, be held liable if the non-performance or improper performance of the contract is attributable to:
- to the customer
- to the unforeseeable and insurmountable event of a third party to the contract
- or to an event of force majeure recognized under French regulations and case law.
HYPEUSE shall not be held liable for any minor color discrepancies that may arise from the settings on the customer’s display, provided that all product photographs and descriptions remain faithful to the products' essential characteristics.
No provision of these General Terms and Conditions limits or excludes any right or warranty that the customer is mandatorily entitled to under the law.
10. Intellectual Property
All elements featured on the HYPEUSE website, including:
- the HYPEUSE name and logo
- the photographs
- the videos
- the texts
- the descriptions
- the illustrations
- graphical elements
- the layout and design of the site,
is protected by intellectual property laws.
Any reproduction, representation, adaptation, distribution, or exploitation, in whole or in part, without prior written authorization from HYPEUSE is prohibited, except as otherwise provided by law.
Access to the website does not grant the customer any ownership rights to the elements that comprise it.
11. Personal data
The personal data collected in connection with orders and use of the Site is processed in compliance with Regulation (EU) 2016/679 (“GDPR”), the French “Informatique et Libertés” Data Protection Act, and the privacy policy of HYPEUSE.
The purposes, legal bases, recipients, and retention periods, as well as the rights of data subjects (access, rectification, erasure, restriction of processing, objection, data portability, and withdrawal of consent where consent serves as the legal basis) are detailed in the Privacy Policy.
The customer may exercise their rights by contacting HYPEUSE at the address listed in the “Customer Service & Complaints” section or in the Privacy Policy.
12. Consumer Mediation
Pursuant to articles L.611-1 and subsequent provisions of the Consumer Code, consumers have the right to use a consumer mediator free of charge in order to amicably resolve any dispute that arises between themselves and HYPEUSE, after submitting a written complaint that did not result in a satisfactory resolution.
The contact details of the competent mediator will be provided to consumers upon simple request, or, where they are known, listed on the Website in accordance with applicable regulations.
13. Governing law & jurisdiction
These General Terms and Conditions of Sale shall be governed by French law, without prejudice to any mandatory consumer protection provisions that may apply to consumers residing in another country.
In the event of a dispute, the customer and HYPEUSE shall endeavor to first seek an amicable resolution.
If no amicable settlement or resolution can be reached through the consumer mediator, the dispute may be brought before the competent courts under the conditions set forth by law.
The consumer customer may in particular initiate proceedings before any court with territorial jurisdiction, pursuant to the rules of civil procedure.

- and, if necessary, to attach photographs.
HYPEUSE will endeavor to respond as quickly as possible.
15. Proof & Archiving
Computerized records, order confirmations, invoices, emails, and all other documents held by HYPEUSE under reasonable security conditions shall be considered valid proof of communications, orders, payments and transactions conducted between the parties.
These documents may be submitted as evidence in the event of a dispute, in accordance with all applicable legal provisions.
16. Amendments to the General Terms and Conditions of Sale
HYPEUSE reserves the right to amend these General Terms of Sale at any time in order to adapt them to legal, regulatory, technical, or commercial developments.
The applicable General Terms and Conditions of Sale are those in effect at the time the customer confirms their order.
New versions will be published on the Site and take effect immediately upon being posted online, unless otherwise stated.
