1. Purpose of the TOS & definitions

These general terms of use (the "TOS") aim to define the terms and conditions under which HYPEUSE (hereinafter the "Publisher") provides HYPEUSE (the "Site"), accessible at https://www.hypeuse.com, and how any person accessing it (the "User") may use it. The purpose of the Site is to be an online store for women's clothing and accessories.

For the purpose of reading these TOS, the following terms have the meanings set forth below:

  • Site: the online service published by the Publisher, its pages, content, and features.
  • User: any person who accesses or uses the Site, with or without an account.
  • Content: any element (texts, images, data, functionalities) accessible via the Site.
  • Publisher: the person responsible for publishing the Site, whose contact details appear in the legal notices.

2. Acceptance of the TOS & modifications

Access to and use of the Site imply full and unreserved acceptance of these TOS by the User. By accessing the Site, the User acknowledges having read them and undertakes to comply with them. Failing acceptance, the User must refrain from using the Site.

The Publisher may modify the TOS at any time, in particular to adapt them to the evolution of the Site or regulations. The applicable version is that in force on the date of access to the Site. Substantial modifications may be communicated by any appropriate means (mention on the Site, notification). Continued use of the Site after a new version has been posted constitutes acceptance thereof; their entry into force takes effect upon their publication.

3. Service access, availability, maintenance and security

The Site is in principle accessible 24 hours a day, 7 days a week, subject to interruptions, particularly for maintenance, updates or in cases of force majeure. The Publisher strives to ensure access under reasonable conditions but cannot guarantee uninterrupted or error-free availability.

The Publisher reserves the right to suspend, limit or interrupt access to all or part of the Site, without notice when urgency justifies it, particularly for maintenance or security operations, without this entitling the User to compensation.

The Publisher implements reasonable technical and organizational measures to preserve the security of the Site. The User is informed that access and equipment costs (hardware, software, connection) remain their responsibility.

4. Accounts & authentication

The use of certain features of the Site may require the creation of an account. The User undertakes to provide accurate information and to keep it up to date. The User is solely responsible for the confidentiality of their identifiers and for any activity carried out from their account.

The User undertakes to inform the Publisher without delay of any unauthorized use of their account. The Publisher may suspend or delete an account in the event of a breach of these TOS, fraudulent use or a risk to the security of the Site.

5. Rules of use & prohibited content

The User undertakes to use the Site fairly, in accordance with its purpose, public order, and applicable laws and regulations, and respecting the rights of third parties.

The following are notably prohibited, without this list being exhaustive:

  • Any use for illicit or fraudulent purposes or infringing the rights of third parties (intellectual property rights, privacy, right to image).
  • The dissemination of illicit, defamatory, abusive, hateful, violent or immoral content.
  • Any attempt to undermine the security or integrity of the Site (intrusion, injection, massive data extraction, unauthorized robots).
  • Any action likely to disrupt the operation of the Site or overload its infrastructure.

The User remains solely responsible for the content they publish or transmit, where applicable, via the Site and guarantees the Publisher against any claims relating thereto.

6. Intellectual property

The Site, its structure, its contents (texts, images, logos, brands, databases, graphic elements and software) are protected by intellectual property law (notably Article L.111-1 of the Intellectual Property Code) and remain the property of the Publisher or its beneficiaries.

The Publisher grants the User a strictly personal, non-exclusive and non-transferable license to use the Site, limited to viewing and using it in accordance with its purpose.

In accordance with Article L.122-4 of the Intellectual Property Code, any reproduction or representation, in whole or in part, made without the consent of the Publisher is illegal; it may constitute an act of infringement (Art. L.335-3) and incur the liability of its author.

The brands, denominations, and logos appearing on the Site are protected (Article L.713-2 of the Intellectual Property Code) and may not be used without the prior consent of their owner.

7. Personal data

As part of the use of the Site, the Publisher may process personal data concerning the User. These processing operations are implemented in accordance with the General Data Protection Regulation (GDPR) and the "Informatique et Libertés" law.

The methods of collection, purposes, legal bases, retention periods, as well as the rights available to the User (access, rectification, erasure, restriction, opposition, portability) are detailed in the Site's Privacy Policy, to which the User is invited to refer.

8. Cookies & trackers

The Site may use cookies and other trackers, which may be subject to the User's consent when required by regulations.

The categories of trackers used, their purposes, as well as the methods for configuring and withdrawing consent are described in the Site's Cookie Policy, to which the User is invited to refer.

9. Responsibilities & limitation

The Publisher uses reasonable means to ensure the accuracy of the information published on the Site and its proper functioning. However, the Site and its content are provided "as is" and for informational purposes; the Publisher cannot guarantee that they are free of errors or that they meet a particular use by the User.

Within the limits permitted by law, the Publisher shall not be held liable for indirect damages resulting from the use or inability to use the Site, nor for malfunctions related to the Internet network, the User's configuration, or a case of force majeure. These stipulations cannot exclude the Publisher's liability in cases where the law prohibits it. When the User acts as a consumer, no clause herein can create a significant imbalance to their detriment within the meaning of Article L.212-1 of the Consumer Code; the rights they hold from imperative provisions remain acquired.

The User is responsible for their use of the Site and the consequences of their actions. The Publisher's responsibility for third-party content is assessed under the conditions provided by the law on trust in the digital economy (LCEN) and Regulation (EU) 2022/2065 (DSA), relating to the liability regime of the host.

10. Hyperlinks & third-party services

The Site may contain hyperlinks or integrate services provided by third parties. The Publisher has no control over these external resources and declines all responsibility for their content, their availability, or the practices of their publishers.

Access to third-party sites or services is the sole responsibility of the User, who is invited to consult the terms of use and policies applicable to these resources. The creation of a link to the Site requires the prior agreement of the Publisher.

11. Financial terms

All or part of the functionalities of the Site may be offered for a fee, where applicable according to a freemium model. The pricing conditions, payment methods and characteristics of paid offers are specified at the time of subscription and, where they exist, in the applicable general terms and conditions of sale.

Access to paid features does not imply any guarantee of uninterrupted availability of the Site, without prejudice to the User's rights provided by law. These TOS govern the use of the Site; the terms of sale govern, where applicable, commercial relations.

12. Termination, account deletion & content deletion

The User may cease using the Site at any time and, if applicable, request the deletion of their account according to the procedures made available on the Site or by contacting the Publisher.

The Publisher reserves the right to suspend or delete, without notice when warranted by gravity, a User's access, their account or any content in the event of a breach of these TOS, unlawful use or risk to the security of the Site. Deletion does not affect the stipulations which, by their nature, are intended to survive (intellectual property, liability, applicable law).

13. Proof & archiving

The computerized records and connection logs kept by the Publisher under reasonable security conditions are considered as evidence of connections, actions, and, where applicable, transactions occurring via the Site.

These elements may be archived on any reliable and durable medium, in accordance with the durations and terms specified in the Privacy Policy, and produced as proof if necessary.

14. Applicable law & jurisdiction

These TOS are governed by French law.

In the event of a dispute relating to their validity, interpretation, or execution, the parties will endeavor to find an amicable solution. Failing agreement, the dispute will be brought before the competent courts of Paris, subject to applicable mandatory rules of jurisdiction, particularly in favor of the consumer.
